Birth Defects Caused by Zofran, According to Lawsuit

Zofran attorneys note that the parents of a boy born in California in 2009 claim that their son suffered from birth defects caused by Zofran, an anti-nausea drug used to treat morning sickness in pregnant women. The parents allege that they were unaware of the risks posed by the drug. Lawsuits against drug maker GlaxoSmithKline (GSK) claim that Zofran was illegally promoted for purposes unapproved by the U.S. Food and Drug Administration (FDA).The parents are seeking compensatory and punitive damages.

Parents Claim They Were Unaware of Link Between Zofran and Heart Defects

Zofran was approved by the FDA for use in controlling cancer patients’ nausea during chemotherapy and radiation treatments. As of June 2015, the drug has not been approved as a treatment for morning sickness, and the California boy’s parents claim that the drug maker never conducted safety trials to determine whether the drug was safe for use in this manner.

According to the family’s complaint, the boy’s mother took Zofran during her first trimester of pregnancy to relieve the symptoms of her morning sickness, which consisted of acute nausea and vomiting. Soon after the boy was born, he was diagnosed with bicuspid aortic stenosis, a condition that occurs when the aortic valve in the heart loses functionality due to malformation. The boy’s parents claims that there is no history of the defect on either side of the family and that the mother would have refrained from use of the drug if she knew the potential side effects. They also claim that they were unaware of the link between the Zofran and heart defects before their son was born.

Affected Patients May Be Entitled to Compensation

It is drug makers’ duty to provide drugs that are safe, and to warn of potential side effects that could pose a danger to patients.  If a drug maker fails to do so, they can be held liable for injuries that may result.

Women who take Zofran during pregnancy and deliver a child with birth defects may be entitled to compensation on behalf of their child. Compensation may include medical expenses, scarring and disfigurement from a child’s birth defect or medical treatment, and pain and suffering.

If a child dies due to complications from a birth defect, the child’s parents may be able to pursue claims for their child’s wrongful death. Wrongful death compensation may include pain, suffering, and mental anguish from the loss of a child, conscious pain and suffering of a loved one prior to death, and funeral expenses.
