Original Judgment of $502 Million Reduced to $151 Million

A U.S. District Court judge cited a Texas state law limiting the amount of punitive damages that can be awarded in making his decision to reduce the award recently given to a group of five plaintiffs. According to Mass Device, the judge ruled to reduce an original, $502 million judgment awarded to patients who were harmed by a Johnson & Johnson defective hip device to $151 million.

At the center of it all is the Ultamet metal-on-metal version of DePuy’s Pinnacle hip device. Plaintiffs claimed they were never made aware of risks associated with the defectively designed hip device, and jurors agreed, originally awarding $360 million in punitive damages and $130 million in total compensatory damages. Johnson & Johnson also face additional battles involving their Pinnacle hip systems, with a new bellwether trial set to begin in October 2016.
