The DePuy CMF Jaw Implant May Cause Complications

The device is designed to lengthen a patient’s lower jaw in the event that he or she was born with a jaw defect or sustained a traumatic facial injury. Over time, the device elongates, stretching the jaw to its desired length.

However, according to DePuy and the U.S. Food and Drug Administration (FDA), the device may suddenly stop lengthening and actually become shorter, posing a severe risk of injury or complications. In infants, failure of the device could cause the trachea to become obstructed. Because infants do not possess the ability to fully control their airways, they are at a risk of experiencing respiratory arrest and/or death. If the device fails in adults, surgical intervention is often necessary to remove the damaged implant and replace it with a new device.

DePuy CMF Jaw Implant Pulled From the Market

DePuy made an announcement on April 16, 2014 to inform its customers that it had identified the aforementioned problems and to direct the medical community to discontinue use of the device. On August 28, 2014, the FDA issue a Class I recall due to the potential for the devices to reverse direction following implantation. According to reports, 15 separate incidents have been filed in which patients claim that the device was the direct cause of their injuries or complications.

While it is always possible to pursue a claim on your own, an experienced personal injury attorney in Iowa may be helpful in proving that your injury was directly caused by the jaw implant. You may be entitled to recover damages for loss of income or earning capacity, pain and suffering, and medical expenses for the various costs you incurred.
