Lawsuit: Baby Will Need Several Surgeries to Treat the Birth Defect

Few studies have been conducted on the effects of Zofran on pregnant women and their babies. CTV News reports that the drug is used off label to treat women who are struggling with hyperemesis gravidarum, an extreme form of morning sickness. Now, a dozen women in Canada are claiming that their use of Zofran led to their children’s birth defects.

One woman says her daughter was born with a cleft palate and cleft lip. The plaintiff claims that she was given the drug through an IV by her doctor, who told her it was safe. Now her daughter will need to undergo several surgeries to treat the birth defect as she grows and the mother is suing GlaxoSmithKline, the maker of the drug.

The U.S. Food and Drug Administration and Canada’s Society of Obstetricians and Gynecologists have both cautioned physicians about giving Zofran to their patients. The drug has not been approved for use in pregnancy and there is not enough evidence out there to prove that it is safe, the website reported.

How a New Jersey Zofran Attorney Can Help

Drug manufacturers have a duty to ensure their products are accompanied by full and accurate instructions and warnings to guide prescribing doctors and other health care providers in making treatment decisions. If a drug maker fails to fulfill this duty, it could be held liable in lawsuits for injuries that may result.

The parents of children who were born with birth defects linked to Zofran may be eligible to recover money for:

  • Medical Expenses
  • Scarring or physical deformities caused by the birth defect or treatment
  • Pain and Suffering

The families of those who have died may be eligible to recover money for funeral expenses and the pain that comes with losing a loved one.
