New York Hip Implant LawsuitsDePuy Pinnacle Metal-On-Metal Hip Replacement System Lawsuit Update

After surgery that replaced both hips with DePuy Pinnacle metal-on-metal hip systems in 2009, one plaintiff experienced severe pain in both hip joints. Due to the discovery of 85 times higher than normal levels of chromium and cobalt in her blood, she developed a serious infection that made the removal of both the Pinnacle hip systems necessary in 2011.

The metal-on-metal Pinnacle system was designed to increase durability, however the system’s metal particles were released into tissue and the blood of patients causing damage to tissue and bone and failure of the device. Johnson & Johnson recalled 93,000 ASR hip implant systems in 2010. The necessity to recall these was due to early failure rates of the systems according to Johnson & Johnson. The FDA asked Johnson & Johnson to modify the Pinnacle hip design, but instead they took it off the market in August 2013.

At this time, more than 6,000 DePuy Pinnacle hip implant lawsuits are awaiting trials in the U.S. District Court for the Northern District of Texas. J&J has now spent more than $2.5 billion to settle ASR system complaints.

Stryker Hip Replacement Lawsuits Update

Hip implant lawsuits have been filed regarding Stryker’s Rejuvenate and the ABG II metal-on-metal hip implants that were recalled in July 2012. Recipients allege that these implants have caused metal poisoning and the devices have failed.

On August 4th, 2014, a Case Management Order was filed regarding two hip implant systems manufactured and sold by Stryker, the Rejuvenate and ABG II, in the New Jersey Multicounty Litigation. Mediation of three of the lawsuits included has been completed. Two of the three have been resolved. The number of cases now completed with mediation is now 21, and the number settled is 19.

Smith & Nephew Hip Implant Lawsuits Update

The Smith & Nephew R3 Acetabular Hip Replacement System’s metal liner caused complications for patients such as metal poisoning. The metal poisoning was caused by metal particles from the liner entering the body. Victims of the devices with metal liners suffered from infection, dislocation and metal sensitivity. 3,000 to 4,000 of the hip replacement systems were sold in the United States. Zimmer Hip Replacement System Update

The U.S. Judicial Panel on Multidistrict Litigation consolidated Zimmer Durom Acetobular Cup cases in 2010. Since then, Zimmer has settled with its Durom Cup plaintiffs at a cost of $400 million to the company and could reportedly continue with further settlements with Zimmer hip replacement victims. The Multidistrict Litigation has begun in the New Jersey district court and state court filings have begun in New York, Idaho and Florida.

Biomet Hip Implant Lawsuits Update

A new order was issued by the US. District Court of the Northern District of Indiana concerning the hundreds of consolidated lawsuits involving the Biomet M2a hip replacement system. Zimmer now owns Biomet, after a recent buyout in 2014. Court documents indicate that more than 1,200 injury lawsuits have been filed at the U.S. District Court of Northern District of Indiana. These plaintiffs allege that the M2a Magnum metal-on-metal hip replacement systems caused metal poisoning due to the device shedding metal toxins. In addition, plaintiffs claim the device has also caused pain, loss of mobility and failure of the hip.

Wright Conserve Hip Implant Lawsuits Update

Nearly 400 lawsuits have been filed that allege the metal-on-metal Wright Conserve Total Hip Implant System, the Conserve Resurfacing System and the A-Class Advanced Metal Implant System have caused debilitating and painful suffering by patients. These lawsuits were filed in the multidistrict litigation court of the Northern District of Georgia. A bellwether trial was established by the court that set up the litigation’s first case to have a jury trial in March 2015.
