Claim: Public Not Warned That Xarelto Was Linked to Deadly Bleeding

The Pennsylvania woman is claiming that she sustained serious injuries because the defendants (Janssen Research & Development, Janssen Ortho, Janssen Pharmaceuticals, Bayer Healthcare Pharmaceuticals, Bayer Pharma AG, Bayer Corporation, Bayer Healthcare, Bayer Healthcare AG and Bayer AG) inaccurately represented the drug. The woman allegedly suffered physical pain, potentially deadly bleeding, mental distress and financial damages due to her use of the blood-thinner, according to The Madison County Record. She is now seeking damages from each defendant, along with coverage of her legal costs.

A spokesperson for Janssen Pharmaceuticals issued a statement regarding Xarelto, stating:

“Xarelto is an important anticoagulant used to treat and reduce the risk of life-threatening blood clots. After more than three years on the U.S. market, and more than 3 million patients prescribed in the U.S. to date, the benefit-risk profile of Xarelto remains favorable and consistent with clinical trials.”

The woman’s complaint alleges that the defendants were both negligent and fraudulent in their representation of Xarelto. The companies marketed the drug as a safe means of reducing the risk of stroke and pulmonary embolism. However, they failed to warn the public that Xarelto has been linked to potentially deadly bleeding events and that the drug was originally marketed without an antidote or reversal agent. As a result, the lawsuit alleges product liability, intentional infliction of emotional distress, fraud, negligence, negligent misrepresentation, fraudulent misrepresentation, express warranty and implied warranty, the website reported.
