Arkansas Man Files New Lawsuit Against Stryker

On April 26, 2013, an Arkansas man named Larry Ball filed a hip recall lawsuit for the many complications caused by not one, but two defective metal-on-metal hip implants he received from Stryker, a medical device manufacturer.

After getting diagnosed with osteoarthritis, Mr. Ball acquired the Stryker Rejuvenate Modular Hip System recommended by his doctor. Since he was only 58 years old, the metal-on-metal system seemed like the best option because it was marketed as having long-lasting properties. It only took a short amount of time before it became apparent that the implants weren’t working the way the way they were intended to.

After less than a year, friction from the metal components rubbing together caused fretting, corrosion and metal toxicity to the tissue surrounding the implants. This resulted in physical pain that Mr. Ball will likely have to tolerate for the rest of his life and the inability to receive income due to permanent disability. Mr. Ball also had to acquire physical therapy, revision surgery for both hips, and long-term care using his own money, putting him at a serious financial loss.

The lawsuit that Mr. Ball filed against Stryker states that the firm is liable for the pain, suffering and expenses that have resulted from the defective Stryker Rejuvenate Modular Hip System. DePuy, a medical device manufacturer owned by Johnson & Johnson, had a similar lawsuit filed against them by a retired Los Angeles security guard who experienced serious complications from his metal-on-metal hip implant. The court found DePuy liable, and the man was awarded $8.3 million dollars.

Other than the case involving the security guard, only one other trial has been settled so far. The other trial involved a Chicago woman seeking compensation for the issues brought about by her defective DePuy metal-on-metal implant. Unfortunately, the Chicago grand jury found no fault in the way that the implant was marketed, and she did not receive any sort of reimbursement for her suffering and medical expenses.
