Near-constant gastrointestinal distress is among the allegations made by the plaintiffs taking part in some of about 1,300 national lawsuits involving the popular blood pressure medication Benicar. According to the New Jersey Law Journal, a federal court in Camden, New Jersey, will soon start hearing the first of 20 planned bellwether trials involving plaintiffs with similar claims.
Complicating matters is a request by Benicar’s manufacturer, Japan-based Daiichi-Sankyo, to utilize the prescribing physicians of some of the plaintiffs as consultants or experts during trial. The drug company also sought to limit communications between these physicians and plaintiffs during that time, arguing that the plaintiffs could potentially alter their doctors’ testimony by trying to distort their memories. While a federal judge denied the request to limit communications between patients and their doctors, the judge did approve the request for the defendants to use prescribing physicians as resources during trial.
