Court: New York Transportation Department Responsible For Man’s Injuries
A man who suffered a punctured lung, broken ribs and other problems after crashing his motorcycle will receive compensation for his injuries from the state of New York, according to an appeals court ruling. The Times Union reports that the man’s attorney was able to refute the state’s claim that it was not aware of the loose gravel in the roadway said to cause the motorcycle crash, and therefore not responsible for removing it.
The plaintiff’s lawyer offered evidence to prove that, contrary to its claims, the New York Department of Transportation (DOT), did in fact, know about the hazardous road condition. He noted that the road where the accident occurred had been paved several weeks before. Furthermore, he added that two DOT representatives were dispatched to the scene shortly after the road was paved because a policeman reported motorists skidding and running off the road because of the debris, the website reported.
