Woman Claims Device Maker Was Aware Of Hip Implant Defects

The lawsuit, filed in February 2016, alleges the plaintiff suffered various complications including metal erosion of the device and blood contamination, as a result of receiving a defectively designed DePuy ASR XL hip implant. The woman received the DePuy hip implant unit in 2008 and is suing DePuy Orthopaedics Inc. and Premier Orthopaedic Sales Inc., claiming that she developed elevated levels of metal in her blood as a result of the device’s alleged design flaws.

The U.S. Food and Drug Administration (FDA) announced a recall of this hip implant unit in 2010, two years after the woman’s hip replacement procedure, citing a risk of shedding metallic debris in patients’ bodies, according to The Cook County Record. The woman claims that DePuy had even earlier knowledge of the device’s defects and was negligent in continuing to sell it. The lawsuit alleges that the DePuy ASR device possessed design flaws that rendered it inherently unsafe. Besides suffering blood contamination, the woman ultimately required revision surgery to remove the defective implant and prevent further contamination. She is now seeking over $50,000 in damages through a product liability lawsuit, the website reports.
