Georgia Zofran Attorney: Drug Maker Failed To Warn Mothers of Risks

Whether drug maker GlaxoSmithKline acted negligently may be determined pending the outcome of one of almost 200 lawsuits alleging that the anti-nausea drug Zofran caused birth defects. According to The Daily Beast, attorneys for plaintiffs around the country may soon have their day in court now that the District Court of Massachusetts has been chosen as the site for Zofran MDL. In one of many lawsuits filed against the drug maker, attorneys for an Idaho woman allege that GlaxoSmithKline was well aware of the drug’s link to birth defects. However, the lawsuit alleges the drug maker failed to reveal this information to patients.

Zofran’s in utero effects have been tested on animals, but not people, leading the U.S. Food and Drug Administration (FDA) to give the drug a “Category B” pregnancy ranking. Attorneys for the plaintiff in the Idaho case plan to reference a 2012 settlement against GlaxoSmithKline in which the drug maker agreed to plead guilty and pay $3 billion to resolve its criminal and civil liability arising from the company’s alleged unlawful promotion of certain prescription drugs. While the 2012 case dealt with drugs other than Zofran, attorneys believe it establishes an alleged pattern of the drug company’s efforts to promote prescription drug use for purposes it knew to be dangerous, the website reported.
