Plaintiffs Claim Former FDA Commissioner Failed to Respond to Complaints

A group of plaintiffs who allege that they experienced psychosis, liver and kidney problems and a host of other issues after taking the prescription drug Levaquin seek a jury trial and damages in a U.S. District Court. According to the The Daily Caller, among those named in the lawsuit is a former FDA commissioner whom the plaintiffs’ legal team argued had ulterior motives in keeping Levaquin on the market.

Appointed to run the FDA from 2009 – 2015, the commissioner is accused of acting outside the scope of her authority to conceal the dangers of the drug for her family’s own financial gain. Her husband, a co-CEO at a major New York hedge fund, held considerable stock in Johnson & Johnson, the maker of Levaquin, and allegedly stood to profit substantially from strong drug sales. Despite receiving “hundreds” of emails from patients detailing Levaquin side effects and two citizen petitions requesting label changes to emphasize a patient’s risk of neurodegenerative diseases and cell damage, the lawsuit claims that the commissioner did nothing.  Though the FDA ultimately recommended strengthening Levaquin’s warning label, the recommended change did not come until after the accused commissioner’s departure, the website reported.
