Lawsuits: Drug Warnings Were Not Strong Enough

Xarelto, approved by the U.S. Food and Drug Administration in 2011, is a commonly used blood thinner that treats and prevents blood clots and also lowers the risk of stroke in patients who have atrial fibrillation. According to the Louisiana Record, Janssen Pharmaceuticals and Bayer Healthcare claim that they did provide patients with sufficient warning about the risk of bleeding associated with the blood thinner, and that it does place a warning on its product cautioning that death is a rare possibility and that bleeding can occur.

The drug makers are the subject of multiple lawsuits that claim the warnings were not strong enough. Those lawsuits also allege that Xarelto was responsible for injury and death to many patients when they suffered uncontrollable bleeding, as unlike traditional anticoagulants whose effects can be reversed through common drugs, Xarelto has no antidote. The litigation is set to begin with four bellwether trials in Texas, Mississippi and Louisiana in the fall of 2016. The trials are intended to help resolve these and other outstanding issues surrounding Xarelto’s alleged deadly side effects, the website reported.

Injured Patients May Be Entitled to Compensation

If a drug maker fails to fulfill its duty to provide safe drugs and to warn of potentially harmful side effects that may be associated with its medication, it could be held liable for any injuries that may result.

Patients who have been injured by Xarelto may be entitled to compensation for damages, including:

  • Medical expenses
  • Pain, suffering, and mental anguish
  • Loss of income or ability to work

If a patient dies from complications after taking Xarelto, his or her family members may be able to pursue claims for their loved one’s wrongful death. Compensation may include:

  • Pain, suffering, and mental anguish from the loss of a loved one
  • Loss of financial support of a loved one
  • Funeral expenses
