According to the plaintiff, he worked at a pipeline company in Texas, Ross School and Tool Company as a laborer between 1961 and 1966 and as an apprentice and at Abco Corp. between 1966 and 1968 as a tool inspector. The lung cancer asbestos case claims that the defendants had prior knowledge of the risks and hazards of asbestos but failed to exercise caution and reasonable care for the safety of the plaintiff.
As the result of the disease caused by asbestos, the plaintiff allegedly became disfigured and disabled, suffering great mental anguish and physical pain and incurring additional medical costs, according to the lung cancer asbestos case. Additionally, he was unable to pursue a normal career and, as a result, lost income that would have otherwise been available to him.
In the complaint, the plaintiffs are asking for exemplary and punitive damages of over $150,000, compensatory damages of over $100,000, economic damages exceeding $150,000 and a judgment of more than $100,000 as well as other relief that the court may feel necessary to provide.
Reasons for a Lung Cancer Asbestos Case
According to many lawsuits, it is not usually the worker’s fault that he or she developed mesothelioma following asbestos exposure. Instead, claims include allegations that the employers or manufacturers of the asbestos-contaminated products are to blame. Although workers are typically told up-front about the risks and dangers that come with each job, it is also up to the company to inform the workers of these hazards and provide a safe environment, to the best extent possible, to help to reduce these risks.
If the manufacturer or employer neglects or fails to warn employees of these risks, even though it is ultimately up to the employee to determine whether the career path is right for him or her, then the employer or manufacturer may be held accountable for any injury or death that may have resulted from the conditions of the workplace.
Plaintiffs filing claims with the help of asbestos lawyers allege that, because symptoms of mesothelioma are mild, they may not have been immediately aware that they were suffering from a serious cancer. Those experienced with the symptoms of mesothelioma acknowledge that it is typically when the disease is in its late stages that workers first become aware of the condition. Symptoms of mesothelioma, according to victims and their asbestos lawyers, include:
- Shortness of breath
- Weight loss
- Bowel obstruction
- Chronic pain near tumor
- Fluid buildup
In addition to seeking compensation for lost income, plaintiffs may also request compensation for medical expenses due to the extensive and expansive treatments that are typically required for combating mesothelioma. Curative surgery, chemotherapy, radiation therapy, palliative surgery and other procedures may be used in an effort to relieve symptoms, shrink tumors, prevent recurrence or kill the malignant cells.
