Report: DePuy Hip Implant Lawsuits Keep Mounting
The plaintiffs in 8,900 cases involving an alleged defective DePuy metal-on-metal hip implant device have renewed hope now that a Dallas, Texas, federal jury has awarded a large verdict to five others making similar allegations. The Dallas Morning News reports that the plaintiffs claim the device at the center of the lawsuits, the Pinnacle prosthetics system, causes an array of serious medical issues, among them tissue loss and bone erosion. It is also prone to premature failure.
The five Texans were awarded a combined $502 million in settlement money, $142 million in actual damages and $360 million in punitive damages. They asserted that, not only was the device defective, but also that its manufacturer, DePuy, and DePuy’s parent company, Johnson & Johnson, were aware of its defects and failed to properly notify the public. To date, the hip implant device has not been recalled, and the nearly 9,000 pending cases involving the Pinnacle hip system are expected to begin in fall 2016, the website reported.
