First DePuy Pinnacle Hip Implant Lawsuit Is Underway

The first of over 6,500 federal DePuy pinnacle hip implant lawsuits against Johnson and Johnson started in Dallas on Sept. 4, 2014. The plaintiff in the case, Kathleen Herlihy-Paoli, claims she experienced severe pain in both hips after receiving defective DePuy Pinnacle metal-on-metal hip replacements in both hips in 2009. Her lawsuit also claims that a serious infection, which caused her to remove the implants, developed after chromium and cobalt levels increased in her bloodstream by 85 percent. Moreover, the plaintiff also alleges that her doctors failed to inform her of these possible risks prior to installing the hip implants. As of today, October 22, 2014, the jury is currently in deliberation, and we are waiting on a verdict.

Benchmark for Future Hip Implant Lawsuits

Many legal experts believe this case will serve as a benchmark for future Texas hip implant lawsuits and other hip implant lawsuits across the country involving Johnson & Johnson’s DePuy division because a verdict for the plaintiff could serve as a determining factor for other cases in the MDL.

Other Bellwether Trials Scheduled to Start Soon

Six other bellwether hip replacement lawsuit trials are scheduled to begin in November and in early January 2015. These trials could be used to initiate a mass settlement process that may prevent other similar hip replacement injury cases from reaching the litigation stage.
