Attorney Says Lawsuit May Be the First of Many to Come

A lawsuit filed in California alleges that silicone breast implants manufactured by Mentor Worldwide, a subsidiary of Johnson & Johnson, are causing several problems, including pain, nausea, skin rashes and extreme fatigue. According to Bloomberg, the lawsuit additionally claims that the manufacturer failed to warn the plaintiff and her physician about “the risk of serious defects and life-altering complications” associated with the defective implants.

The U.S. Food and Drug Administration lifted its 14-year ban on silicone implants in 2006, and only three companies are currently allowed to sell the devices in the U.S., including Mentor Worldwide. Breast implant makers faced thousands of lawsuits during the 1980s and 90s, leading some companies to file bankruptcy in the wake of sizable settlements.

The lawsuit is the second complaint filed against Mentor and J&J after a woman claimed in September 2016 that the company’s silicone implants made her sick, allegedly leaving heavy metals in her bloodstream. Attorneys believe that problems related to the implants may have harmed thousands of women and that more lawsuits may follow, the website reported.

How a Defective Breast Implant Attorney Can Help

Medical device makers have a duty to provide safe products. If there are risks of harm associated with their devices, they also must provide adequate warnings. If a device maker fails to fulfill this duty, it could be held liable in lawsuits for injuries that may result.

People injured by leaking breast implants may be eligible to recover money for:

  • Medical Expenses
  • Lost Wages
  • Pain and Suffering

The families of those killed may be eligible to recover money for funeral expenses and the pain that comes with losing a loved one.
