A $2.5 million verdict was reached in favor of an Oklahoma woman to compensate her for damages she sustained when her ASR hip replacement system when she suffered complications from the device.

Plaintiff Receives $2.5 Million Verdictdepuy orthopaedics

The Oklahoma plaintiff was fitted with the company’s ASR hip replacement in her right side in October 2006, and received an identical implantation in her left side the following year. According to the plaintiff, she required a series of unexpected and painful hip revision surgeries three years later to address the metallosis in her body, which can be caused by friction between the metal parts, releasing fragments into the bloodstream.

The plaintiff alleged she suffered anguish and stress due to the revision surgeries. An Oklahoma jury awarded the woman $2.5 million in compensatory damages, calculated based on her past, present, and future financial harm incurred from the alleged negligence of DePuy Orthopaedics.

In 2010, DePuy Orthopaedics and Johnson & Johnson reportedly recalled 93,000 ASR hip implants, and there are four separate litigations proceeding against the companies in federal and state courts throughout the U.S. In 2013, the manufacturers agreed to a $2.5 billion settlement to resolve approximately 7,500 cases alleging that the ASR device was inherently defective and prone to early failure.
