Plaintiffs Claim to Have Been Injured by Defective Hip Implants

A third bellwether trial involving Johnson & Johnson and six plaintiffs who claim they were injured by defective DePuy Pinnacle hip implants has begun in a federal court in Dallas. According to a report issued by Law360, the manufacturers of the implants argue that the combination of multiple plaintiffs have led to unfair results, pointing to a verdict of $502 million awarded in March 2016. Although the verdict was reduced to $150 million under Texas law, the company complained of the judge’s decision to allow evidence that was allegedly questionable and its ability to properly defend itself in the face of the allegations made against them.

While DePuy Orthopaedics, a division of Johnson & Johnson, claims that its products are backed by a strong record of clinical data and evidence that demonstrate the company acted responsibly in the development of the hip implants, the company has faced a number of lawsuits alleging that patients were injured by defective hip implants. In past litigation, Johnson & Johnson attempted to present itself in the best light possible and reportedly left the door open for evidence about the company’s misdeeds and other motivations. Johnson & Johnson has reportedly refused to discuss a settlement offer, and lawyers for the plaintiffs could ask the court to remand any pending MDL cases and begin pursuing as many as 30 cases a year.
