According to reports, there are 1,400 additional DePuy ASR metal-on-metal hip patients eligible to participate in the DePuy settlement program as of February 26, 2014. The manufacturer, DePuy Orthopaedics, has agreed to extend program to include eligible ASR hip implant recipients in the U.S. who underwent revision surgeries to replace their hips on or before January 31, 2015. The original program was first announced in November 2013 and has successfully compensated eligible ASR recipients who underwent surgery to replace the device prior to August 31, 2013.

DePuy Settlements Could Reach $4 Billion

Depuy Settlements The agreement between the Court-appointed committee of lawyers who represent ASR hip recipients and the company was reported on February 20, 2015. A spokeswoman for DePuy acknowledged that by extending the benefits to include an additional group of ASR recipients, the company is again offering “fair compensation to U.S. ASR patients” without unnecessary delays as well as the uncertainty of the legal process. According to the company, DePuy remains committed to the well-being of ASR recipients.

The new agreement allows an additional 1,400 patients who underwent removal procedures to seek up to $300,000 per revision in compensation. These individuals will be joining an estimated 8,000 other cases included in the initial agreement, and the existing settlement program has now paid many of the more than 7,500 individuals who enrolled in the program.

According to Bloomberg.com, the most recent extension will cost DePuy approximately $420 million, bringing the total amount of compensation payments to an estimated $3 billion. In addition, Bloomberg indicates that the extension will also resolve more than 90 percent of the lawsuits currently pending against the company. By the time all of the implant cases are resolved, DePuy ASR lawsuit attorneys estimate the total cost of the DePuy settlements, including cases that were resolved outside of the settlement program, to exceed $4 billion.
