Over 100,000 Vehicles Reportedly Equipped with Cheating Software

A class action lawsuit alleges that Fiat Chrysler deceived customers, the Environmental Protection Agency (EPA) and other regulators, including the California Air Resources Board (CARB), through their promotion and sale of certain EcoDiesel® branded trucks and SUVs. According to the lawsuit, affected vehicles were equipped with a defeat device, or software algorithm, on engine management systems. The installed defeat devices detect emissions and adjust the vehicles’ emissions controls to allow them to pass emissions testing. As a result of alleged misrepresentations made by the defendants in the class action, plaintiffs and other potential class members purchased or leased affected vehicles that did not perform as claimed.

Affected vehicles equipped with Fiat Chrysler’s 3.0-liter EcoDiesel® include:

  • 2014-2016 Ram 1500
  • 2014-2016 Jeep Grand Cherokee

In January 2017, the EPA and CARB issued separate Notices of Violation to Fiat Chrysler for violations of the Clean Air Act after detecting “auxiliary emissions control devices” in some of their EcoDiesel® vehicles. Vehicle manufacturers are required to disclose any software that could potentially modify emissions. Fiat Chrysler knew this, but allegedly failed to do so. Plaintiffs in the case claim to have suffered economic damages due the reduction in value of vehicles equipped with the defeat devices. Those vehicles would not have been able to pass emissions testing without using the cheat devices.
