Class Action: Defective Intel Processor Fix Could Slow Performance

An Intel class action lawsuit has been filed on behalf of individuals who purchased products containing a potentially defective Intel core processor. Although Intel has developed a “patch” to allegedly fix the defect in many of its processors, plaintiffs claim that the patch slows the performance of the processors and doesn’t fix the problem for many consumers. Affected individuals may be able to pursue a claim with the help of a consumer fraud attorney.

Fundamental Flaw Reportedly Leaves Millions of Processors Vulnerable

In late 2017, researchers discovered a fundamental flaw in Intel computer processors that could allow malicious users to gather sensitive data, including passwords, credit card information, emails and other personal information. According to New York Magazine, two separate exploits, known as Meltdown and Spectre, have been around for decades and could potentially affect every Intel processor made since 1995. This includes almost every computer, laptop, tablet, and smart phone that contains an Intel processor in addition to cloud-based services offered by Amazon, Apple, Google and Microsoft.

Since learning of the alleged defective nature of millions of its processors, Intel issued a “patch” to fix the potentially serious security vulnerability. However, according to a proposed class action filed in California, fixing the alleged security defect causes the processors to slow down. As a result of the processors’ degraded performance, plaintiffs claim to have “suffered loss of money or property” while Intel Corporation has “failed to remedy the harm, and has earned and continues to earn substantial profit from selling defective processors.”

Intel responded by saying that they believe that “these exploits do not have the potential to corrupt, modify or delete data” and that processors developed by other vendors may be susceptible to the exploits as well. Consumers are advised to check for any available operating system or manufacturer updates to help protect against malicious activity and possible exploitation.

How an Intel Class Action Lawsuit Can Help

When a company engages in false or misleading advertising of its products, or otherwise commits deceptive trade practices, that company could be liable for any damage that result.

The actions of the defendants could constitute fraud and misrepresentation, breach of implied warranty, as well as violations of various state and local consumer protection laws, including California state laws.

Compensation may be sought for:

  • Replacement of affected processor(s)
  • Loss of use
  • Costs incurred by owners, including loss of value, attributable to any wrongful conduct
  • Refund of the purchase price paid for affected services, including the purchase of new processors
  • Attorneys’ fees

Individuals who purchased any product containing a potentially defective Intel processor may be eligible to pursue damages through an Intel class action lawsuit and are encouraged to seek the advice of an experienced consumer fraud attorney to learn more about their rights and remedies.
