Zen Magnet Recall Ordered By Judge Citing Fatal Injury Risk

Over 917,000 Magnets Included In The Zen Magnet Recall

Nearly four years after federal regulators dealt with the makers of super-powerful desktop magnetic toys Buckyballs, filing a lawsuit against the company and persuading retailers to stop selling the dangerous toys, a Colorado-based company has been ordered to recall similarly powerful magnets that can cause fatal injuries if swallowed.

According to consumerist.com, The U.S. Consumer Product Safety Commission (CPSC) and the U.S. Department of Justice (DOJ) filed suit against Zen Magnets and its owner in May 2015. The government alleged that the owner bought 917,000 magnets from Star Networks shortly before Star Networks recalled the magnets and then sold those magnets after they were recalled. Sale of recalled products is illegal in the United States. Finding a substantial likelihood that Zen Magnets had violated the Consumer Product Safety Act, which prohibits the sale of recalled products, the court issued an injunction in March 2016 and directed Zen Magnets to destroy any remaining magnetic spheres in its possession.

The CPSC Chairman commented after the ruling, stating:

“The Court’s order to stop the ongoing sale of these recalled high-powered magnets is a big victory for the safety of children. Along with the U.S. Department of Justice, we will continue to move aggressively to enforce the law and protect consumers from the sale of recalled products, especially those that put children at risk.”

Nearly 3,000 incidents of children swallowing the small balls were reported to the CPSC during a five-year period from 2009 to 2013. Some of the accidents required emergency surgery because if two or more balls are swallowed, they can bind intestinal tissue together, the website reported.
