What is Belsomra?

Belsomra (suvorexant) is a sleep medicine that helps regulate a person’s sleep and wake cycle. Belsomra is regarded as the first of a new generation of sleeping pills called orexin receptor antagonists. Rather than increasing a neurotransmitter that slows brain activity, it decreases the neurotransmitter Orexin, which promotes wakefulness. The drug was approved by the U.S. Food and Drug Administration (FDA) in 2014, and is manufactured by the Merck, Sharpe & Dohme Corporation.

Belsomra and FDA Safety Reports

According to consumerreports.org, an analysis of more than 1,000 safety reports submitted to the FDA concerning Belsomra, found that it was associated with side effects such as disturbed sleep, agitation, and next-day drowsiness, and reports that the drug did not work at all. In the first two quarters of 2015, 1,016 adverse event reports were submitted to the FDA concerning Belsomra.

When a company engages in false or misleading advertising of its products or services, or otherwise commits deceptive trade practices, that company could be liable for any damage that result. If the allegations of misrepresentation of the efficacy of a drug are proven, patients may be able to recover the costs they paid for the medication along with compensation if any possible injuries have occurred as a result of taking the drug.

Drug manufacturers have a duty to ensure their products are accompanied by full and accurate instructions and warnings to guide prescribing doctors and other health care providers in making treatment decisions. If a drug maker fails to fulfill this duty, it could be held liable in lawsuits for injuries and damages that may result.

When patients suffer from severe side effects from a dangerous or defective drug, they may be entitled to compensation for their injuries and damages. The types of losses that can be recovered include:

  • Economic Losses
  • Medical and other treatment expenses
  • Pain, suffering, and mental anguish
  • Loss of income or ability to work

If the conduct of a drug company in manufacturing and selling drug is found to be highly reckless, punitive damages may be awarded to punish the company and deter similar conduct in the future.
