With hundreds of cases pending in federal multidistrict litigation (MDL) involving the blood thinner Xarelto, some may wonder if a Xarelto settlement has been reached. While no large-scale settlements have been reached, Xarelto lawsuits continue to allege that the drug can lead to severe and potentially fatal internal bleeding.

What is Xarelto and Why Have Lawsuits Been Filed?

Xarelto was originally designed to be an alternative to the widely used blood thinning medication Warfarin. It was made available to patients beginning in 2010. Like many drugs, Xarelto has the risk of specific side effects. However, many of the current Xarelto cases allege side effects for which patients claim proper warnings were not given, including:

  • Deep vein thrombosis
  • Gastrointestinal hemorrhage
  • Hemorrhage
  • Pulmonary embolism
  • Death

In addition to these adverse events, many claimants allege that Janssen Pharmaceuticals, Inc. and Bayer Healthcare failed to advise physicians and patients about the lack of an antidote to the drug in the event of uncontrollable bleeding. Excess bleeding caused by Warfarin, another widely used blood thinning medication, can be combatted with an injection of Vitamin K. Lawsuits allege that the drug makers failed to disclose potentially life-threatening risks of Xarelto.

Has a Xarelto Settlement Been Reached?

Although there are hundreds of cases still pending regarding the use Xarelto, no specific settlement figures are currently available. However, if a Xarelto settlement is reached, it will not bar patients who have been injured or family members of those who have died from subsequently bringing claims against the drug maker. The settlement of one case generally does not impact another person’s right to bring a separate case.

Injured Patients May Be Entitled to Compensation

Drug makers have a duty to provide safe drugs. If adverse side effects are possible that could pose a danger to patients, it is also the duty of the drug maker to provide adequate warnings. Patients who have taken Xarelto and suffered internal bleeding or other severe complications may be entitled to compensation for damages resulting from injury. Damages can include:

  • Pain, suffering, and mental anguish resulting from injury
  • Medical expenses
  • Loss of income
  • Loss of ability to work

If a patient dies after taking Xarelto, his or her family members may be able to recover wrongful death damages, including:

  • Medical expenses attributable to the fatal injury
  • Loss of relationship with the deceased loved one
  • Loss of financial support
  • Conscious pain and suffering of a loved one prior to death
  • Mental anguish resulting from the loss of a loved one
