What Is A Morcellation Hysterectomy?

A hysterectomy is the surgical removal of the uterus. It is normally taken out in one piece, however, the use of a power morcellator allows it to be cut and taken out in multiple pieces. Hysterectomies sometimes leaves large scars, usually up to seven inches in length, and require many days in the hospital leading up to and following the surgery. A morcellation hysterectomy is less invasive, allowing the incision to be much smaller and for fewer days to be spent under care.

Risks of Morcellation Hysterectomy

A 2014 study concluded that using a morcellator during surgery greatly increases the cancer risk to the patient. The morcellator tool is powered, which makes cutting and removing the tissue much easier, but the actual process of cutting can spread cancerous particles throughout the abdomen. This can promote the development of uterine cancer or scatter existing cancer tissues, essentially spreading the cancer. Increased cancer risk has also been linked with using a morcellator during a myomectomy, which is the process of removing uterine fibroids or cancerous growths from the uterus.

FDA Warning Issued

In 2014, nearly ten years after the agency first approved the first power morcellation device, the Food and Drug Administration (FDA), issued a safety warning regarding these medical devices. This warning recommended that physicians stop the use of these devices during hysterectomy or myomectomy procedures for the removal of uterine fibroids.

Morcellator Cancer Lawsuits Filed in the U.S.

Lawsuits have been filed against several morcellator manufacturers by patients who have been diagnosed with uterine cancers. Their claims allege that the device makers did not warn patients about the risks associated with morcellators and that they manufactured defective products.

Those harmed as a result of a morcellation hysterectomy are seeking compensation for their injuries with the assistance of a morcellation hysterectomy lawyer.

Injured Patients May Be Entitled to Compensation

Medical device manufacturers have a duty to produce safe products. They also must warn the public of any known dangers associated with the product. If they violate these obligations, they can be held liable if a patient sustains an injury.

Patients who suffer complications as a result of a morcellation hysterectomy procedure may be entitled to compensation for their injuries, including:

  • Past and future medical expenses
  • Pain, suffering and mental anguish
  • Disfigurement from the injury
  • Loss of income or ability to work
  • Scarring from medical treatment for the injury

If a patient dies from morcellation complications, family members can pursue compensation for the wrongful death of their loved one, including:

  • Loss of financial support or companionship
  • Pain, mental anguish and suffering from the loss of a loved one
  • Conscious suffering and pain of a loved one before death
  • Medical expenses attributable to a fatal injury
  • Funeral expenses

Patients who have suffered severe complications from a morcellation hysterectomy procedure as well as the families of those who have died as a result of complications with the device, are encouraged to seek the advice of a morcellation hysterectomy lawyer to learn more about their rights and remedies.
