Claim: School District Failed to Provide a Safe Work Environment

A high school teacher in Minnesota has announced plans to seek damages from his School District in the wake of a traumatic brain injury that allegedly occurred when a student attacked him. CBSlocal.com reports that the incident occurred when the teacher attempted to stop a fight between two students. One of the students, who later pled guilty to felony assault, allegedly began choking the teacher and forcibly slamming him against nearby surfaces. The teacher now alleges that the School District failed to provide a safe work environment.

The teacher reported that he has suffered brain damage and other complications as a result of the attack, adding that he has not been capable of resuming work since the December 2015 injury. In addition to experiencing headaches and vision problems, he has been forced to return to the hospital multiple times for ongoing treatment. The lawsuit claims that the School District had knowledge of the harassment, violence, or assaultive behavior of its students, but did not take any appropriate disciplinary action, nor did the School District take any remedial action to prevent assaultive or dangerous conduct, the website reported.
