Pinnacle Metal Hip Verdict: $498 Million

According to Law360:

After a two-month trial and days of deliberations, a Dallas jury found in favor of all five plaintiffs in the trial, delivering a verdict that included $360 million in punitive damages.

The jury found for the plaintiffs on their failure-to-warn and design defect claims, holding both J&J and DePuy liable, he said. $240 million of the punitive damages were assessed directly against J&J while DePuy is on the hook for the other $120 million. The $140 million in compensatory damages will be divided among the plaintiffs based on the extent of their individual injuries.

Deputy Pinnacle Hip Replacement Complications

DePuy Pinnacle Hip Replacement Attorneys have previously noted complications and side effects with the devices, which include:

  • Clicking noises from the joint
  • Dislocation
  • Discomfort or serious pain
  • Decreased range of motion
  • Difficulty walking
  • Implant failure
  • Additional surgery

In addition, some patients have experienced a condition called metallosis, which is essentially blood poisoning caused by the release of metal particles from the implant when the components of the device rub together. In addition to other complications, metallosis can make it necessary for additional surgeries to correct the condition.

Injured Patients May Be Entitled to Compensation

Medical device makers have a duty to provide safe products. If there are risks of harm associated with their devices, they also must provide adequate warnings. If a device maker fails to fulfill this duty, it could be held liable in lawsuits for injuries that may result.

Although each case is different and the Pinnacle metal hip verdict does not guarantee future outcomes of cases, patients who are injured by their DePuy hip replacement may be entitled to compensation for damages, including:

  • Medical expenses
  • The permanency of the injury
  • Pain, suffering, and mental anguish
  • Loss of income or ability to work

If a patient dies from complications related to a defective DePuy Pinnacle hip replacement, family members may be entitled to compensation for the wrongful death of their loved one, including:

  • Conscious pain and suffering of a loved one prior to death
  • Pain, suffering, and mental anguish from the loss of a loved one
  • Funeral expenses

Patients who have suffered severe complications from a DePuy Pinnacle hip replacement, as well as the families of those who have died as a result of complications with the device, are encouraged to seek the advice of a metal on metal hip lawsuit attorney to learn more about their rights and remedies.
