Lawsuit Claims Manufacturer Lied About E-Liquid Safety

An e-liquids lawsuit alleges the makers of e-liquids, the fluid that fuels e-cigarettes, withheld the dangers of their products from consumers. The lawsuit also alleges that the defendant used misleading advertising campaigns and deceptive practices to entice consumers to buy their products. E-cigarette lawsuit attorneys note that e-liquids, also known as “vape juices”, have been found to contain hazardous substances known as diacetyl as well as cancer causing chemicals such as formaldehyde.

Study Suggests E-Liquids Contain Lung-Destroying Toxins

According to the lawsuit filed in California against Cuttwood LLC, the e-liquids that the defendants manufacture, sell, and distribute, contain toxic substances known as diacetyl and acetyl propionyl, which have been reported to cause bronchitis obliterans, a degenerative and often irreversible respiratory condition that can require a lung transplant. (The condition is also known as “popcorn lung” due to its historical prevalence at a certain facility that made microwave popcorn.) A study funded by the National Institute of Health revealed that 75-percent of the 51 flavored e-liquids tested contain the very dangerous chemical diacetyl, highly-addictive nicotine, and cancer-causing formaldehyde.

The lawsuit, filed in November 2015, also alleges that the e-liquid manufacturer engaged in a misleading and false advertising campaign to entice consumers to buy their products. As a result of this deception, the plaintiffs and others have purchased the e-liquids without being warned of the dangers and health risks that are associated with the vapor liquids. The plaintiffs are seeking a judgement requiring the defendants to return all revenues and profits obtained by any wrongful act or practice, exemplary and punitive damages, and attorney fees and costs.

Affected Consumers May be Entitled to Compensation

When a company engages in false or misleading advertising of its products, that company could be liable for any damages that result. In the e-liquids lawsuit, if the allegations of misrepresentation and false advertising against the company are proven, customers may be able to recover the costs they paid for the e-liquids, along with other damages or injuries that may occur because of the alleged dangerous product.

Affected consumers are encouraged to seek the advice of an experienced attorney to learn more about their rights and remedies.
