Claim: High Price of Popular Auto-Injector Could Put Children and Adults at Risk

In November 2016, a Mylan EpiPen class action lawsuit was filed in the state of California claiming that the company committed unconscionable price gouging. According to the lawsuit, Mylan’s unfair increase in the price of EpiPens potentially leaves thousands of California children and adults at risk of death because they are not able to afford the cost of the auto-injectors. Before Mylan acquired the EpiPen in 2007, the auto-injector was priced at $57 per injector. Mylan now charges over $600 per two-pack after having raised the price 15 times in just seven years. The plaintiff in the lawsuit is representing other individuals who purchased EpiPens manufactured and sold by Mylan.

Epinephrine is a medication and hormone used for the emergency treatment of severe allergic reactions caused by foods, insect bites or stings, medicines, or other substances. Approved by the U.S. Food and Drug Administration (FDA) in 1987, the EpiPen is the most popular epinephrine auto-injector on the market, and patients are often advised to keep the medication on hand if they are at risk for a severe allergic reaction.

Mylan’s CEO testified that the price increase was justified because the company needed to recoup over $1 billion it invested “to enhance the product and make it more available.” According to the lawsuit, however, not much has changed with regards to the product’s formula and most of the money spent on the product has been put toward marketing and lobbying costs.
