Pinnacle Hip Implant Update: Lawsuit Details

The lawsuit alleges that the plaintiff underwent a total left hip arthroplasty in early 2007 in order to correct osteoarthritis within the hip joint. During surgery, he received a ceramic-on-metal bearing implant that eventually started to wear down and cause extensive friction and damage within the joint.

As the joint wore down, it allegedly released significant amounts of toxic metal ions into the plaintiff’s body causing constant pain and discomfort in the joint, which affected his leg and foot. The plaintiff eventually entered the care of a different doctor, who discovered the degenerative hip implant and subsequent chromium and cobalt poisoning. The doctor immediately removed the faulty hip implant and replaced it with a ceramic-on-plastic bearing surface implant.

FDA Approval of Pinnacle Device Questioned

In the class action suit, plaintiff questions whether or not FDA approval for the Pinnacle hip implant was actually granted. Although the individual components of the implant were separately approved, the entire ceramic-on-metal bearing surface combination was not. The plaintiff also claims that the device maker did not file the proper premarket approval application or perform the mandatory two-year clinical trial for the system until 2009, more than two years after plaintiff’s initial surgery took place.
