Seagate Hard Drive Lawsuit Alleges False Advertising

A Seagate hard drive lawsuit alleges that customers were misled into buying the Seagate Barracuda 3TB Hard Disk Drive and Seagate Backup Plus 3TB External Hard Disk Drive, which were defective and did not have the capability of performing as advertised. Seagate Technology LLC, a hard drive manufacturer and distributor and the second largest hard drive manufacturer in the world, is facing claims of deceptive marketing and false advertising in its promotion of its 3TB hard drives as a “major milestone for the hard drive industry.” A Seagate hard drive lawsuit may be an option for customers affected by these defective hard drives.

Lawsuit: Seagate Misrepresented Hard Drives’ Capabilities

The lawsuit claims that Seagate sold the hard drives under misleading terms and that the lifetime of the drives was greatly exaggerated by the company. In claiming that its Barracuda 3TB and Backup Plus 3TB were innovative, fast, powerful, reliable, dependable, and having low failure rates, Seagate allegedly misled consumers into buying its hard drives.

The lawsuit, filed in February 2016, alleges that Seagate:

  • Violated the False Advertising Law
  • Violated California’s Consumer Legal Remedies Act
  • Failed to conform to their express and implied warranties
  • Failed to deliver non-defective hard drives

Because all of Seagate’s 3TB hard drives were prone to high failure rates, the lawsuit alleges, replacing those drives with the same model was not an effective solution. As a result of the violations and breaches by Seagate, the plaintiff is seeking damages from replacement costs, loss of data and data recovery expenses, attorney fees and costs, and other relief deemed appropriate by the court.

Affected Consumers May be Entitled to Compensation

When a company engages in false or misleading advertising of its products, or otherwise commits deceptive trade practices, that company could be liable for any damage that result. In the Seagate defective hard drive lawsuit, if the allegations of misrepresentation and false advertising against the company are proven, customers may be able to recover the costs they paid for the hard drives, along with other damages for loss of data and data recovery expenses.

Affected consumers are encouraged to seek the advice of an experienced attorney to learn more about their rights and remedies.
