Defective Airbags Allegedly Linked to Serious Injury and Death

On January 13, 2017, Takata agreed to plead guilty to criminal wrongdoing after three former senior Takata executives were charged with falsifying test results in order to conceal dangerous ruptures of its airbag inflators. According to Reuters, Takata Corp of Japan has agreed to pay a total of $1 billion to resolve an investigation led by the U.S. Justice Department. The airbag manufacturer will reportedly pay a $25 million fine, $850 million to compensate automaker’s recall costs, and $125 million to a victim compensation fund.

Massive recalls have been initiated in the wake of reports of defective Takata airbags exploding with excessive force, potentially sending metal shrapnel at passengers. As of January 2017, 11 deaths and 184 injuries in the U.S. have been allegedly linked to the inflators inside the airbags. Airbag replacements could take years as more than 100 million vehicles involving 19 automakers have been recalled worldwide. Nearly 70 million Takata airbags have been recalled in the U.S. alone, the website reported.

How a Takata Airbag Recall Attorney Can Help

Although the manufacturer has agreed to pay a fine, including millions of dollars to a victim compensation fund, drivers or passengers who are injured by a defective Takata airbag may be entitled to compensation for damages resulting from their injuries. Compensation can include:

  • Medical expenses
  • Loss of income and ability to work
  • Pain and suffering

If the actions of the airbag manufacturer are malicious or so reckless that intent to harm can be inferred, the responsible party can be liable for punitive damages to punish wrongful conduct and deter similar conduct in the future.

If a loved one dies as a result of a defective Takata airbag, his or her family members may be able to pursue compensation for the wrongful death of their loved one.
