AndroGel Maker First To Face Trial

According to Forbes.com, a Chicago court has consolidated several of these suits into bellwether cases that will be heard in 2016. The first drug maker to face trial will be AbbVie, maker of the popular AndroGel. The lawsuits allege that AbbVie and other testosterone makers endangered healthy men by marketing the hormone to treat sexual dysfunction, age-related fatigue and other symptoms that go beyond what the product is approved by the U.S. Food and Drug Administration (FDA) to treat (hypogonadism, a serious hormonal decline caused by disease or injury).

Earlier in 2015, the FDA issued a warning about a potential link between the hormone treatment and increased risk of heart attack and stroke. The testosterone treatments were not approved by the FDA for people who were experiencing low testosterone levels due to the aging process. However, it is alleged that this did not prevent manufacturers such as AbbVie from marketing the drug to the general public and to doctors as the answer to low libido, reduced energy and depression, the website reported.

Injured Patients May Be Entitled to Compensation

If a drug maker fails to fulfill its duty to provide safe drugs and to warn of potentially harmful side effects that may be associated with its medication, it could be held liable for any injuries that may result. Patients who have been injured by testosterone replacement therapy drugs may be entitled to compensation for damages, including:

  • Medical expenses
  • Pain, suffering, and mental anguish
  • Loss of income or ability to work

If a patient dies from complications after a testosterone drug, his or her family members may be able to pursue claims for their loved one’s wrongful death. Compensation may include:

  • Pain, suffering, and mental anguish from the loss of a loved one
  • Loss of a loved one’s financial support
  • Funeral expenses

Affected patients are encouraged to speak with a testosterone lawsuit attorney to learn more about their rights and remedies.
