Tommie Copper Lawsuit Alleges False Advertising

A Tommie Copper lawsuit filed by the Federal Trade Commission (FTC) alleges that customers were misled into buying Tommie Copper apparel and accessories, that do not perform as advertised. Tommie Copper is facing claims of deceptive marketing in its promotion of its line of clothing and accessories as providing pain relief and having various health benefits, when clinical tests suggest no therapeutic effect for copper or copper-infused compression fabric.

FTC: Tommie Copper Misrepresented Its Clothing Capabilities

Athletic apparel company Tommie Copper has been advertising that their line of copper-infused compression clothing, including shirts, socks, braces, and sleeves, could relieve severe and chronic pain and inflammation caused by arthritis and other diseases.  However, according to the FTC lawsuit, the company’s claims were false and unsubstantiated. The company ultimately paid $1.35 million to settle these false advertising claims.

The Director of the FTC’s Bureau of Consumer Protection stated:

“It’s tempting to believe that wearing certain clothing will eliminate severe pain, but Tommie Copper Inc. didn’t have science to back its claims. If you see an ad for a product that promises to replace the need for drugs or surgery, talk to a healthcare professional before you spend your money.”

Under the terms of the proposed settlement with the agency, Tommie Copper is permanently prohibited from making claims that their products provide pain relief comparable or superior to drugs or surgery unless it has competent and reliable scientific evidence to substantiate those claims.

The settlement of the FTC lawsuit does not prevent consumers from pursuing their own claims for false advertising or deceptive marketing.
