Lawsuit: Defective Axle to Blame for Fiery Train Accident

A train injury lawyer notes that a defective axle may be the cause of a fiery train accident, as other axles from the same batch have been subject to recall. The accident is allegedly to blame for the engineer’s post-traumatic stress disorder as well. When people are injured or killed in train accidents, the injured party or surviving family members may be eligible to seek compensation with the help of a train accident attorney.

Plaintiff Claims to Have Suffered Post-Traumatic Stress Disorder After Crash

The National Transportation Safety Board has recalled 43 axles made by Pennsylvania-based Standard Steel, all of which came from the same batch as an axle a train engineer says is to blame for a fiery 2013 train accident. According to the Washington Times, the engineer, a plaintiff in a new lawsuit filed against the steel manufacturer, claims he suffered post-traumatic stress disorder because of the company’s failure to warn him about the defective axle.

The incident occurred when the train the engineer was operating collided with another on the track that had derailed in front of it. He now seeks unspecified damages from Standard Steel, which, for its part, denies the plaintiff’s claims that the product placed him at risk and was marketed despite its dangerous and unreasonably defective condition. The BNSF Railway, which operates the freight railroad network on which the accident occurred, is also named in the lawsuit.

How a Train Injury Lawyer Can Help

Train conductors and railroad owners have a duty to make sure that they operate and maintain their trains in a safe manner. If this duty is not fulfilled, fatal accidents may occur, and the train driver or train company can be held liable for injuries that may result.

People who are injured in train accidents may be entitled to compensation for damages resulting from their injuries, including:

  • Medical Expenses
  • Lost Wages
  • Pain and Suffering

The families of those killed may be eligible to recover money for funeral expenses and the pain that comes with losing a loved one.

People who have been injured in a train accident are advised to seek the counsel of a Mississippi train accident lawyer to learn more about their rights and remedies.
