Years of Pain And Suffering Due to TVM, Claims Woman

According to Reuters, the lawsuit involved a woman who had a transvaginal mesh procedure performed in 2009, followed by years of complications that involved much pain and suffering. Though two separate surgeries were undertaken to remove the device, the woman claimed pieces of the transvaginal mesh still remain and continue to cause discomfort.

The Delaware jury’s verdict against the Massachusetts based company followed a two-week trial. The jury found Boston Scientific had been negligent in designing and making the devices, and that it had failed to warn patients and doctors about potential risks.

Reports: Five Other Verdicts Against Company

Following the award of $25 million in compensatory damages, and an additional $75 million in punitive damages against Boston Scientific, the TVM manufacturer vowed to appeal the verdict and stated that it strongly disagreed with the verdict.

Reuters reports that the verdict is the sixth so far against the company by women who claim that the devices are poorly designed and use subpar materials, resulting in painful physical injuries such as bleeding, infection and pain during intercourse. Boston Scientific has denied that the products are defective or that it failed to warn about potential complications.

Injured Patients May Be Entitled To Compensation

Patients who have suffered medical complications from TVM may be entitled to damages resulting from their injuries, including:

  • Medical expenses
  • Lost wages or ability to work
  • Pain, suffering, and mental anguish

If a loved one dies from complications caused by a transvaginal mesh implant, family members may be eligible to pursue compensation for the wrongful death of their loved one, including:

  • Funeral expenses
  • Medical expenses prior to death
  • Mental anguish associated with the loss of a family member
