Trinity guardrail accident attorneys note a Bloomberg Business article reporting on a criminal investigation launched by the U.S. Justice Department over a Trinity Industries highway guardrail system that has been linked to at least eight fatalities. The investigation follows more than 12 months of scrutiny for Trinity from states and in lawsuits over the performance of its ET-Plus guardrail system, a product intended to absorb the impact of vehicles that crash into it head-on.

Federal Investigators Looking into Relationship Between Trinity and Government Officials
ET-Plus system reportedly passed a series of crash tests conducted by the Federal Highway Administration (FHWA) and concluded in January 2015, although engineering experts subsequently disputed the results of those tests. According to the Bloomberg report, federal investigators from a public corruption and special prosecutions unit of the Justice Department are now interviewing potential witnesses about issues including Trinity’s relationship with the FHWA. Previous news reports have looked at the increase of Trinity political contributions in the wake of guardrail lawsuits.
In October 2014, a Texas jury in a whistleblower lawsuit brought against Trinity by found that the company had cheated taxpayers of more than $175 million by altering a specific part of the ET-Plus system in 2005 without notifying the FHWA. The plaintiffs claimed that those alterations were intended as a cost-cutting measure and caused the device to malfunction by making it prone to seizing up and impaling vehicles and their occupants instead of absorbing the shock of a collision.
