Couple Alleges AndroGel was Falsely Advertised
The U.S. Food and Drug Administration approved AndroGel in 2000 as a treatment for males with medically diagnosed low testosterone. The 61-year-old man who filed the lawsuit suffered from hypogonadism, which involves diminished or lack of testosterone production, a vital male hormone. The man visited his doctor for treatment and was prescribed the AndroGel. He subsequently suffered from multiple blood clots in his legs and lungs, which he claims will require life-long treatment.
The couple claims that the drug maker’s advertising sought to create a specific image of the product and belief that AndroGel was a safe and effective method of alleviating symptoms of low testosterone. They further allege that the drug makers falsely advertised AndroGel as having few side effects.
According to the complaint, the claims made in the advertising of AndroGel by AbbVie and Abbot Laboratories were disproven by multiple studies showing the dangers of testosterone drugs, specifically their connection to an increased risk of heart attacks, stroke and emboli. Despite the studies’ results, the lawsuit claims that the company continued to market the product as safe for regular use.
Injured Patients May Be Entitled to Compensation
Drug makers have a duty to provide safe drugs, and must also provide warnings if any potentially severe side effects could result from taking a drug. Failure to fulfill these duties could result in a drug maker being held liable if a patient is injured or killed.
Patients who are injured, or loved ones of those killed after taking AndroGel, may be entitled to compensation for damages. Patients who are injured may be entitled to medical expenses, loss of income or ability to work, and pain, suffering, and mental anguish. Loved ones of those killed may be entitled to funeral expenses, mental anguish from the loss of a loved one, and pain and suffering of a loved one prior to death.
