Couple File Plane Crash Lawsuit

A small cargo plane went down and crashed into a residence on Nov. 18, 2014, near Midway Airport in Chicago, missing the couple who lived in the home by just eight inches, according to authorities. The plane landed in the couple’s living room, and the weight of the plane and wreckage caused the room to collapse into the basement. One week later, the couple filed a plane crash lawsuit against the airline that owned the plane. APTOPIX Chicago Plane Into Home

According to the claim that was filed in Cook County Circuit Court, the couple has been under severe emotional distress since the crash, and the plane severely damaged their home as it tore through the bedroom and living room walls, crushing their belongings. While the couple fortunately did not sustain any physical injuries, the couple’s lawyer has indicated that the emotional trauma has been devastating.

The plane crash lawsuit does not name the pilot as a defendant but accuses Central Airlines of neglecting to execute a proper take-off and landing and failing to maintain sufficient altitude. The plane company also allegedly failed to properly maintain, inspect, and control the airplane, according to the suit. The couple’s attorney has obtained a protective order to preserve the general maintenance records, voice recordings, radar reports, plane wreckage, and communication records between the pilot and air traffic control.

While plane crashes are not as common as motor vehicle or train accidents, the devastation caused by airplane wrecks are often much more catastrophic due to the sheer size and weight of the aircraft. In cases in which injured victims decide to pursue a claim for compensation, it is important to seek legal counsel as they may be entitled to hold more than one entity responsible for their injuries, including the pilot, commanding agencies, the owner of the airplane, airline personnel, the manufacturer of the plane’s parts, the plane’s maintenance team, or even other passengers on board at the time of the incident.
