Plaintiff Allegedly Developed Nerve Condition After Giving Birth

A couple was recently awarded $16 million after a jury found truth in the plaintiffs’ claims that staff breached the hospital’s standard of care and caused the woman to suffer permanent injuries. According to AL.com, the female plaintiff claimed a nurse refused to let her shift positions during childbirth, as had been discussed, and held her baby inside her for about six minutes despite the fact that the baby was crowning.

As a result of the incident, the woman developed a debilitating nerve condition called pudendal neuralgia that left her in near-constant pain and exhaustion and kept her from being sexually active.  She was awarded $5 million in punitive damages and $10 million in compensatory damages for reckless fraud and injuries sustained during childbirth, respectively. Her husband was awarded $1 million for loss of consortium. The plaintiff claimed she initially chose the hospital because it marketed itself as a facility willing to accommodate natural birth plans.
