Lawsuit Claims Defendants Delayed Treatment or Provided Negligent Care

According to the Cook County Record, a family filed a lawsuit in November 2015 claims that a group of nursing home defendants were negligent in their responsibility to care for their loved one, a patient in one of the defendants’ facilities, after she started having trouble breathing, and that they allegedly failed to treat the woman in a timely manner.

After the patient started experiencing shortness of breath and other symptoms, a chest X-ray and blood work were performed at the living center. The mother was then taken to a local hospital, where her condition deteriorated and she passed away a day later. There was no information on how soon that work was performed after the mother started experiencing problems but the lawsuit alleges the defendants delayed treatment or provided negligent care for the plaintiff’s mother. The Villa at Evergreen Park and the Little Company of Mary Hospital are among the defendants named in the lawsuit, the website reported.

How A Nursing Home Negligence Attorney Can Help

Nursing home owners and operators have a duty to provide for the care and safety of their residents. If they allow residents to suffer nursing home abuse or neglect, they could be held liable in a nursing home neglect lawsuit for injuries that may result.

Residents who are injured though abuse or neglect may be entitled to compensation for damages, including:

  • Medical expenses
  • The permanency of the injury
  • Pain, suffering, and mental anguish
  • Scarring or disfigurements caused by an injury or treatment for the injury

If a resident dies as a result of nursing home abuse or neglect, family members may be entitled to compensation for the wrongful death of their loved one, including:

  • Conscious pain and suffering of a loved one prior to death
  • Pain, suffering, and mental anguish from the loss of a loved one
  • Funeral expenses

Also, families should consider seeking the advice of a nursing home negligence attorney to learn more about the possibility of pursuing a nursing home neglect lawsuit in order to seek compensation for the death or injury of their loved one.
