Lawsuit Alleges Misbranding And Non-Disclosure Of Drug Risks

According to cherokeephoenix.org, the Cherokee Nation claims that the drug makers did not brand Risperdal correctly and that it did not disclose the potential risks of the drug, especially to elderly users. The plaintiffs claim that the defendants engaged in unethical practices with the intent to defraud the Cherokee Nation, its elderly members, and the region’s disabled persons, as well as medical providers such as prescribers and health care program staff.

The lawsuit, filed in July, 2015, alleges that Johnson & Johnson and Janssen Pharmaceuticals admitted to selling the anti-psychotic drug for unapproved uses to the Cherokee Nation over a decade ago. Originally filed in April, 2015 in the Sequoyah County Court, the lawsuit has advanced to the Oklahoma Federal Court for review.
