Tracy Morgan Update: Walmart Driver Awake More Than 28 Hours Before Accident

Trucking accident lawyers note news sources are reporting on findings of the National Transportation Safety Board (NTSB) that the driver of the Wal-Mart tractor-trailer that slammed into a limo carrying comedian Tracy Morgan last June had been awake more than 28 hours. The Tracy Morgan accident made big news in June 2014, when the comedian and three other passengers were seriously injured and fellow comedian James McNair was killed. The Georgia-based Wal-Mart truck driver was charged with four counts of assault by auto and one count of death in state court.

Truck Driver Fatigue: Tragic Consequences

ABC News quoted NTSB senior accident investigator Dennis Collins as saying that the crash highlighted the “consequences of even one poor decision regarding fatigue.” Moments before the crash, the truck was travelling more than 20 mph over the construction zone’s speed limit of 45mph. The NTSB further added, “Had the truck driver been travelling at the posted work zone speed limit, it could have stopped before impact”.

The comedian later filed a civil suit against Walmart and they reached a confidential settlement in May. The retailer, which initially faulted Morgan and his colleagues for not wearing their seat belts, later took full responsibility for the accident.
