Direct Filing Approved for Xarelto MDL

Xarelto Litigation Overview

Xarelto was introduced in 2011 as an alternative to the blood thinner Coumadin (also known as warfarin), and has been linked to severe bleeding and other complications. Makers of Xarelto allegedly promote it as easier to use than warfarin on the basis that regular blood monitoring is not required. However, studies have raised questions about these claims, suggesting that blood monitoring could help in identifying those at greatest risk of severe bleeding. Johnson & Johnson’s Janssen subsidiary and Bayer Healthcare are currently facing more than 300 Xarelto bleeding lawsuits alleging they failed to disclose risks of severe complications linked with the drug.

The U.S. Judicial Panel on Multidistrict Litigation determined in December 2014 that all federally-filed cases would be consolidated as part of an MDL to avoid conflicting rulings, reduce duplicative discovery, and to make the process more efficient for the parties. The Xarelto MDL is pending in the Eastern District of Louisiana.

Xarelto MDL Pretrial Order

On March 24, 2015, the U.S. District Judge overseeing the Xarelto MDL issued a pretrial order permitting Xarelto cases to be filed directly into the MDL. The order is meant to avoid delays in the transfer of cases from U.S. District Courts to the Eastern District of Louisiana, where the MDL is pending.
